1. Acceptance of Terms

By accessing, browsing, or submitting content to Been Dicked ("the Platform", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must discontinue use of the Platform immediately.

2. Federal Safe Harbor (47 U.S.C. § 230 Immunity)

Been Dicked operates as an Interactive Computer Service Provider under Section 230 of the Communications Decency Act (47 U.S.C. § 230(c)(1)).

"No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider."

Consumer reviews, grievance narratives, and billing reports hosted on this platform are submitted by independent third-party consumers or aggregated verbatim from public records. Been Dicked does not author, fabricate, or adopt these statements as its own.

3. Consumer Review Fairness Act (15 U.S.C. § 45b)

Under the federal Consumer Review Fairness Act (CRFA), clauses in consumer contracts or retainer agreements that prohibit, penalize, or restrict honest reviews, or that attempt to force consumers to transfer copyright in their reviews, are void and unenforceable as a matter of federal law. Attempting to threaten consumers with liquidated damages or gag orders for filing factual complaints constitutes an unfair and deceptive trade practice.

4. Anti-SLAPP Notice to Listed Entities

This Platform exercises constitutionally protected free speech regarding matters of vital public interest, consumer fraud, unlicensed practice, and unfair commercial practices under the First Amendment of the United States Constitution and the Alabama Constitution.

Any attempt to chill, intimidate, or weaponize frivolous defamation lawsuits against this Platform or its reviewers ("Strategic Lawsuits Against Public Participation" / SLAPP) will be vigorously defended, and we will pursue all available statutory fee-shifting, sanctions, and malicious prosecution remedies.

5. Rules for User Submissions

When reporting a business or submitting evidence:

• Truthfulness: All statements must be factually true, accurate, and based on firsthand experience.
• No Defamatory Fabrications: Submitting provably false or malicious statements is strictly forbidden.
• No Doxxing: You may not submit home addresses, private mobile numbers, personal banking details, or medical records of private individuals.
• License: By submitting content, you grant Been Dicked a non-exclusive, perpetual, worldwide license to archive, display, and categorize the submission for public transparency.

6. Disclaimer of Warranties & Limitation of Liability

Been Dicked is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations regarding the commercial fitness of listed entities. The mathematical Dick-O-Meter score is an automated, transparent index based solely on reported complaint severity and licensing filings. In no event shall Been Dicked be liable for any indirect, consequential, or economic loss arising from information published on the site.

7. Disputes, Corrections & Notice Procedure

If a business entity believes a review contains a material factual falsehood or has documentation proving full resolution of a grievance, official documentation may be submitted to our review board at: legal@beendicked.com.
